About Workshop:

The discussion will be led by Claudio N. Rechden, Principal Counsel and Global Legal Lead for Special Operations at the International Finance Corporation (the private sector arm of the World Bank). Claudio has extensive international finance, cross-border restructuring and litigation experience, and has served  as IFC’s primary in-house counsel for several distressed investments worldwide. Claudio also teaches a course on International Debt Workouts at Georgetown University Law Center, and has previously taught on the subject at Stanford Law School and University of Miami Law School.

In this roundtable discussion, we will cover the practical aspects for practitioners to consider when involved in cross-border debt workouts. Such aspects are based on the INSOL Principles and his experience from handling debt workouts globally as part of the IFC legal department and its special operations unit. More specifically, the discussion will cover the due diligence phase (establishing the workout team; identifying risks), devising a workout strategy (risk allocation, understanding the alternatives available based on the legal/local framework), working with other lenders, negotiations in distressed transactions, and cross-cultural aspects.
